Family to sue after UCF Player dies

Quote:
UCF has six months to respond to intent to sue notice
Mark Fainaru-Wada
August 1, 2008
The parents of a 19-year-old University of Central Florida football player who died following a March conditioning workout filed notice Friday that they intend to bring a wrongful death lawsuit against the school.

Ereck Plancher, a redshirt freshman wide receiver from Naples, Fla., collapsed March 18 after a 20-minute training session on the Orlando campus. Last week, the Orange County Medical Examiner said the cause of death was connected to Plancher possessing the sickle cell trait -- a condition that the National Athletic Trainers Association (NATA) believes has been tied to 10 deaths since 2000.

Plancher "experienced exhaustion, dizziness, shortness of breath, and other signs of extreme fatigue that were ignored by trainers and/or coaches of the University of Central Florida," according to the notice, which was sent to the chairman of the UCF Board of Trustees, as well as the Florida Department of Financial Services. "As a direct and proximate result of the University of Central Florida's negligence, Ereck Plancher collapsed and died."

Impact: This guy was doing what he loved and was getting to go to school free to do it. He knew what he was doing. I expected the family to attempt to profit from their son's death, I just still don't see the sense in it. Kids are very resiliant, and this will most likely lead them to perform strongly for their fallen brother. Draft your UCF guys with confidence.

Most law suits, IMO, lack sense. Perhaps though, in some sort of way it comforts the family, maybe it pays for funeral expenses, maybe to them, it's some form of justice. I can't really say, never been there, hopefully, never will.

Yeah...just sounds like a family trying to cash in. If the kid has a condition, I am sure there was a waiver signed stating that it was his choice to continue or play even because I am sure if he did not sign it, they would have said we cannot risk your health and therefore you cannot play. I can't see the coaches even forcing him to play too hard with that condition. He'll, you never know...they kid like most competitive athletes probably said "Don't treat me like I am handicapped or special, just treat me like all the other kids and push me to be the best I can be."

Well Danny, Im sure the school would have kicked in to help out with those expenses if asked. Its still just a shame. Of course we dont know the kid, but as he sits in heaven, do you really think hed want his family to sue the crap out of a school that gave him a chance to get an education while doing what he loved? Could be wrong, but I doubt it.
