REPORT: TRAVIS HENRY TESTS POSITIVE FOR MARIJUANA

FOX 31 in Denver reports that Broncos running back Travis Henry has tested positive for marijuana.

The development subjects Henry to a one-year banishment from the NFL, given that he was suspended for four games within the past two years for violating the league's substance abuse policy.

Henry has the right to appeal the positive test. If the outcome is upheld, he'll be gone for at least a year.

He signed a five-year, $22 million contract with the Broncos, including $12 million in guaranteed money, after the Titans released him prior to the due date of a large roster bonus. The substance abuse policy now controls the extent to which Henry will have to pay signing bonus money back to the team.

Henry most recently drew headlines when it was reported that he has fathered nine children with nine different women. Once suspended, his ability to make those child-support payments will become slightly impaired.

HENRY SUING TO BLOCK SUSPENSION

In a novel legal strategy that, for now, isn't completely clear, Broncos running back Travis Henry has been fighting in court since September 20 to keep the NFL from using against him a urine sample that presumably tested positive for marijuana.

Per Newsday, Henry sought a restraining order last month in Suffolk County, New York to prevent the NFL from using the specimen against him.

The skirmish also has spawned a federal court action -- possibly filed by the NFL to compel Henry to rely upon the arbitration procedures set forth in the collective bargaining agreement.

Absent further details, the effort seems to be a proactive Hail Mary pass from Henry aimed at preventing the league from taking the inevitable step of suspending him. And with nine mouths to feed and no other obvious marketable skills, we can't say we blame him for trying.

Henry won't win that lawsuit. I just read the NFLPA drug testing agreement (http://www.nflpa.org/pdfs/RulesAndRe...olicy_2006.pdf) and it explicitly says that they can suspend for drug arrests or any other state evidence indicating that a player tests positive for a banned substance. He's done.

The Broncos incidentally have a clause in his contract that says they can recoup his signing bonus if he fails a drug test. That means they could release him day 1 of his suspension and the only money they are out is his salary for this year.

I don't know if any of you remember Lee Flowers or the circumstances surrounding Denver's decision not to sign Mike Anderson, but I can guarantee you that if they can cut loose of this guy they won't hesitate.

The drug test occurred sometime in September. Henry would have been off his 2-year probation on Oct. 1 (at which point it would have been a 4 game suspension).

What an idiot.

I own Selvin Young in 2 out of 3 leagues now - actually got him earlier with word of Henry's nagging injury pains. Go get Young in your leagues too if he is still available!

May not be that simple. Henry is claiming that the NFL did not follow their own policy and allow Henry's representatives to be present at the testing. If this is what their own policy calls for and they did not follow their own rules, this could indeed get tossed out.

This is actually not the case.

the issue is this. the policy allows you to have an expert there during the testing. Not as the sample is taken. Part of that rule though is that expert may not have any affiliation with another lab, Henry's does. NFL sent a list of ten others he could choose, instead he sued.

This of course is also to test his "B" sample. the "A" sample was tested and it failed. If the "B" sample fails, he is suspended. I agree with the above...this is over, and he is toast.
